Intellectual property, particularly trademarks, plays a vital role in a company’s success. Each year, numerous trademark applications are filed, but not all are approved. Some trademarks fail to get registered due to abandonment or non-compliance with legal requirements. To assess an application's eligibility, it undergoes a formal review and examination in accordance with the provisions of the Trademark Act. This process determines whether the trademark faces refusal under Section 9 or Section 11 or has other deficiencies that need correction. If the application does not meet the Act's criteria, the Examiner issues a report outlining the objections. The applicant must then respond with justifications for why the trademark should be registered.
